Terms of Service

1. Acceptance of Terms

By creating an account or using the Spark mobile application ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App. Spark is operated by Lumyn Spark.

2. Who May Use Spark

Spark is intended for use by parents and legal guardians on behalf of their children ages 7–12. You must be at least 18 years old to create an account. By registering, you confirm that you are the parent or legal guardian of any child profile you add to the account.

3. Subscriptions and Billing

• Spark offers a free trial period for new accounts. After the trial, continued access requires an active paid subscription.
• Subscriptions are billed monthly at the stated price and renew automatically until cancelled.
• You may cancel your subscription at any time through the billing portal at lumynspark.com. Cancellation takes effect at the end of the current billing period.
• Payments are processed securely by Stripe. We do not store your payment card details.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, hack, or otherwise compromise the App or its infrastructure.
• Upload content that is harmful, abusive, or violates any applicable law.
• Share your account credentials with others.

5. AI-Generated Content

The App uses artificial intelligence to generate tutoring responses. While we strive for accuracy, AI-generated content may occasionally contain errors. Spark is a supplemental learning tool and is not a substitute for professional educational services. Parents are encouraged to review session content with their children.

6. Intellectual Property

All content, design, and software in the App are the property of Lumyn Spark. You may not copy, reproduce, or distribute any part of the App without prior written permission. Content you upload (such as book photos) remains yours; you grant us a limited license to process it solely to provide the tutoring service.

7. Account Termination

You may delete your account at any time from within the App. Deletion is permanent and removes all associated data. We reserve the right to suspend or terminate accounts that violate these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, Lumyn Spark is not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
